These Terms of Use ("Terms") govern your use of the Flying Start application ("the App") developed by Softwidget Ltd ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

⚠️ Safety Notice

Flying Start is a navigational aid only. It is not a substitute for proper seamanship, lookout, or compliance with the Racing Rules of Sailing. GPS accuracy varies with conditions and device hardware. You are solely responsible for the safe operation of your vessel at all times. Never rely exclusively on the App for race timing, positioning, or navigation decisions.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices you own or control, subject to the Apple Media Services Terms and Conditions.

2. Free and Premium Features

The App offers a free tier with basic countdown features and an optional premium subscription ("Flying Start Pro") that unlocks additional features. Premium features require an active subscription.

3. Subscriptions

Subscriptions are billed monthly ($2.99 USD) or annually ($19.99 USD) through your Apple ID account.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
You can manage or cancel subscriptions in your Apple ID account settings.
No refunds are provided for partial subscription periods. Refund requests should be directed to Apple.
Prices may vary by region and are subject to change. Any price changes will apply to the next renewal period.

4. GPS and Location Services

Certain features require access to your device's location services.
GPS accuracy depends on hardware, satellite visibility, atmospheric conditions, and other factors outside our control.
We make no guarantee of GPS accuracy or availability.
Start line calculations (DTL, TTL, OCS detection) are estimates based on GPS data and should not be relied upon as the sole basis for racing decisions.

5. Apple Watch

The Apple Watch companion app is included with a Flying Start Pro subscription. Apple Watch GPS accuracy may differ from iPhone GPS accuracy. The Watch app is subject to watchOS limitations including battery life and background processing restrictions.

6. Assumption of Risk

Sailing and yacht racing are inherently dangerous activities. By using the App during sailing or racing activities, you acknowledge and accept the risks involved. You agree that:

The App is a supplementary tool and does not replace the need for proper training, equipment, and seamanship.
You will maintain a proper lookout at all times as required by the International Regulations for Preventing Collisions at Sea (COLREGS).
You will not allow use of the App to distract from the safe operation of your vessel.
You are responsible for complying with all applicable racing rules, sailing instructions, and maritime regulations.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Softwidget Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for personal injury, property damage, loss of revenue, or loss of data, arising from your use of or inability to use the App.

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Intellectual Property

The App, including its design, code, graphics, and content, is the property of Softwidget Ltd and is protected by copyright and other intellectual property laws.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
